Lawyer Danstan Omari Sues CS Aisha Jumwa over KSh 17 Million Unpaid Legal Fees

Source: Facebook Danstan Omari sues Aisha Jumwa The lawyer alleges that Jumwa, whom she represented in a corruption case involving the National Government Constituency Development Funds, owes him KSh 17.4 million, which she allegedly refused to pay.  In his application, Omari says the CS never paid him for his services when she was charged in a Mombasa court for allegedly embezzling CDF funds totaling KSh 19 million. Through the law firm Musyoki Mogaka and Company Advocates, Omari demands the amount as a client's bill of costs from legal services rendered in fees to cover instructions to represent Jumwa. He defines the matter as a complex anti-corruption case, which the Director of Public Prosecutions later dropped. Is Danstan Omari Aisha Jumwa's lawyer? "Fees to cover instructions to represent the respondent in the complex Mombasa anti-corruption case number 6 of 2020, Republic vs. Aisha Jumwa and 7 others, where the respondent was charged with the following criminal charges," the application seen by TUKO.co.ke read. Omari, through his law firm, says that Jumwa ought to pay him after he acted for her in the case where she was charged with conspiracy to commit an offense of corruption, money laundering, acquisition of proceeds of crime, and conflict of interest. The breakdown for this amounts to KSh 10 million. He wants a further KSh 200,000 for drawing and filing a criminal revision for a case he filed on behalf of Jumwa three years ago in an application dated August 28, 2020, at the High Court of Kenya for a review of orders issued. According to Omari, Jumwa must also pay for drafting and filing cagers for chamber summons dated August 28, 2020. The lawyer wants compensation for seeking orders to be heard during the court’s vacation at the Mombasa Law Courts. Why Danstan Omari wants Aisha Jumwa to pay him? Omari, in his breakdown, further indicated that Jumwa should pay him and his firm KSh 3 million for attending court for hearings and mentions in 2020. In the suit filed before the commercial magistrate's court, Omari wants the CS to pay him another KSh 3 million for preparing for the numerous court hearings and mentions. "To attend court for hearings and mentions of the various applications filed, preparing for the numerous court hearings and mentions. 3,000,000," states Omari. The advocate also included KSh 550,000 as printing costs. "For telephone calls, printing and binding, photocopying, filing, and other expenses incurred for the petition and application," read the court papers. Aisha Jumwa Acquitted after DPP withdraws corruption case Former Director of Public Prosecutions Noordin Haji withdrew the corruption charges against Jumwa, who then served as Malindi MP under Section 87(a) of the Criminal Procedure Code in October 2022. In the matter, Jumwa was accused of conspiracy to commit fraud through the payment of KSh 19 million to Multiserve contractors with respect to tender number MLD/NG-CDF/01/2017/2018 of Malindi NG-CDF. She was charged alongside Wachu Omar, Kennedy Otieno, Bernard Riba, Sophia Saidi, Margaret Kalume, Robert Katana, and Multiserve contractors.
