Police are threatening me, says petitioner in Mumias Sugar case

 

A petitioner in the Mumias Sugar Company Insolvency case has sensationally claimed that the police have been threatening her with arrests if she does not surrender documents related to the case.

Lawyer Jackline Kimeto has told the court that the DCI has been weaponised by parties yet to be determined to intimidate her from pursuing her claim.

In court documents filed in court, she says that on June 12 this year she received an unsigned summons from the DCI for allegedly making an inquiry into an alleged offense of conspiring to defraud.

Kimeto says that the summons further directed her to go with all documents in support of her claims against Mumias Sugar.

However, Kimeto says it’s been difficult to comply with the summons fully even though she honoured them, it will be difficult to surrender the documents requested by the police because they are protected and privileged.

She argues that it was clear that parties in the case are using state machinery to settle personal scores and intimidate her from pursuing her claim.

She said that the current state of events has caused a lot of anxiety for the lawyer who now fears attending court because of the threats of arrests.

Kimeto has also claimed that Justice Alfred Mabeya was intimidated and threatened after the delivery of a ruling in April that allegedly made him recuse himself from the matter.

She also claims that on February 18 last year she was threatened by a party in the case and she reported it at Kilimani police station but to date no action has been taken against the said perpetrators.

“This is a collateral attack on the petition before this court and the application to appoint a new administrator as well as to call the 1st and 2nd respondents to account for their activities at the 3rd respondent's company that is currently before this court,” reads court papers   BY THE STAR
