The High Court has awarded Sh44.5 million in damages to a man who developed brain damage as a result of an operation he underwent 14 years ago at a private city hospital.
In his ruling on Wednesday, High Court Judge George Odunga also awarded Sh1 million to the parents of the patient.
The patient’s parents had sued the Nairobi Hospital on behalf of their son, who at the time of the operation, was 14-year-old.
The patient was then a student at St Mary’s High School.
The boy was rushed to the hospital after sustaining a nasal fracture during a basketball game.
He, however, developed brain damage for which his parents blamed the anaesthetist, the ear, nose and throat surgeon and the hospital.
