Six off the hook on robbery with violence charges

robbery with violenceSix suspects were on Monday cleared of robbery with violence charges.
Mombasa Resident Magistrate Edga Kagoni ruled that the evidence against the suspects was inadequate.
"The police have failed to link the suspects to the Ceska pistol earlier claimed was in their possession. There is totally no evidence to suggest that the rifle was recovered from the suspects," Mr Kagoni said.
Mohamed Mwachande, Mohamed Salim, Kassim Ali, Mohamed Abdalla, Ali Omar and Mwinyi Katibu were accused of robbing police constable Mohamed Ibrahim of his Ceska pistol loaded with 15 rounds of ammunition and shooting him on March 25, 2015.
"Due to failure by the investigating officer to directly link the suspects to the incident, the court cannot therefore put them on their defence. I find that the suspects have no case to answer," he argued.
CRIME SCENE
The Resident Magistrate said the detective and the evidence could not place the suspects at the crime scene, and the argument about theft and recovery of the gun was not convincing.
The suspects had denied the offence.
While Mr Katibu walked to freedom, the rest were locked up as they still have terrorism related cases to answer.
MURDER
They are charged with stealing a G3 rifle from Constable Simon Lochodo on October 2, 2015.
Mr Mwichande and Mr Salim are accused of robbing Private George Hongo of an M4 rifle, which was loaded with 30 rounds of ammunition, and killing him on November 2 at Nyali barracks.
They are further charged with conspiracy to commit an act of terrorism.
