Former Cabinet Secretary Raphael Tuju has disputed the proposed auction of the company’s Karen properties, saying the dispute remains before the courts.
Tuju was responding to an auction notice by Garam Auctioneers announcing the sale of Entim Sidai Wellness Sanctuary in Karen, Nairobi, on Tuesday, August 25, 2026.
The notice describes the property as measuring approximately 20 acres.
In his statement, Tuju said Dari Limited and the East African Development Bank (EADB) remain involved in several legal proceedings concerning the property and questioned the decision to proceed with the auction while the cases are pending.
“The matter of that.. sale is currently the subject of litigation at the Auctioneer’s Tribunal and the High Court,” he stated.
He also cited Supreme Court case SCPT/E012/2023, Dari Limited versus East African Development Bank, as one of the proceedings relating to the dispute. According to Tuju, Dari Limited received communication from the Registrar of the Supreme Court dated August 20 and 21, 2026, indicating that the matter remains before the court, with a ruling yet to be delivered.
He also referred to a case before the High Court Commercial Division, E636 of 2024, as well as criminal case E042 of 2025 at the Milimani Law Courts.
Tuju further disputed allegations that Dari Limited had failed to comply with High Court conditions requiring it to deposit Sh50 million as security in the ongoing loan dispute.
“The deposit was made on 5th June 2026. A copy of bank statements is attached, and the bank or our lawyers may be contacted directly, as they are signatories to the account,” he said.
The Dari chairman said the company had been involved in litigation concerning its properties for more than seven years and urged potential buyers to consider the pending cases before participating in any sale.
The statement also referred to Dari’s property along Ngong Road in Karen, where Tuju said an earlier auction in 2024 was also the subject of ongoing proceedings before the Auctioneers Tribunal and the High Court.
He further mentioned the March 13, 2026, raid on the Ngong Road premises, saying the property had remained closed amid the legal proceedings.
The proposed auction therefore places the long-running Dari-EADB dispute back in the spotlight, with the company maintaining that the ownership and financial issues surrounding the Karen property have yet to be finally determined by the courts.
The dispute between Dari Limited and the East African Development Bank (EADB) centres on a loan and the enforcement of security linked to the debt.
The matter has been subject to ongoing litigation.
In a ruling delivered in May, former Cabinet Secretary Raphael Tuju suffered a setback after the High Court declined to interfere with the completed auction of the multi-billion-shilling Dari Business Park in Karen, Nairobi.
Justice Moses Ado held that the court could not overturn the transfer of the property, which had already been sold and transferred to a third-party purchaser nearly two years earlier. However, the judge temporarily shielded Tuju’s Entim Sidai Wellness Sanctuary in Karen from enforcement of the bank’s statutory power of sale, which would allow the lender to auction the property to recover the outstanding debt.
The order was conditional on Tuju depositing Sh50 million as security within 30 days.
“The plaintiff (Tuju) shall, within 30 days, deposit security in the sum of Sh50 million in an interest-earning joint account in the names of counsel for the parties, failing which the stay order shall automatically lapse,” the judge ruled.
