Ferdinand Waititu has secured Ksh 53M bank guarantee in a bid to regain his freedom

Former Kiambu Governor Ferdinand Ndung’u Waititu has informed the court that he has secured a Ksh 53 million bank guarantee in a bid to regain his freedom.

This emerged during the mention of his hate-speech case before Magistrate Rose Ndobi.

The magistrate has set the hearing date for January 15th, 2026.

The former governor, who appeared in court under the guard of prison officers, has been in custody since February this year.

Waititu, who is currently serving a sentence for corruption-related offences at Kamiti Maximum Prison, is charged over remarks he allegedly made on September 29, 2024, at Ruiru Stadium in Kiambu County.

According to the charge sheet, the statements directed at groups including “hustlers,” market vendors, boda boda operators, clergy, and teachers were intended to provoke a breach of the peace and implied violent outcomes against political figures.

The alleged conduct is said to contravene Section 94(1) of the Penal Code, which prohibits offensive behaviour likely to incite public unrest.

The prosecution alleges that Waititu made the statements publicly with the intention of creating tension among the audience.

The former governor has already been formally charged with the hate speech charges and pleaded not guilty.

Waititu remains in custody as he awaits to secure his release from prison.
